The following terms and conditions set out the basis on which all services, rental, training, courses, dive bookings, charters, merchandise and operations that are offered, sold and/or made by PURE DIVING ARUBA (Trading as PDA, Marcel van Wees, Steven Koedijk, Eco Diving, Aruba’s Eco Dive Center/Shop, Dive Consultant, Dive Operator/Center/School), (“We”, “Us”, “Our”, “The Company”), to and/or with the purchaser, (“You”, “Your”), from our websites (“the Site”), by Telephone or in person in the Centre or on the Boat.
These terms and conditions, together with Our Privacy Policy and any order form or payment instructions comprise the whole agreement between You and Us in relation to each sale, for example course or boat booking we accept from you.
By making a booking via the site, over the telephone, email or in person you agree to be bound by these terms and conditions.
By making a booking you acknowledge that You have not relied on any statement, warranty or representation other than those which are made in these terms and conditions, Our Privacy Policy, any order form or any payment instructions.
- Equipment Rental
1..1. When accepting the rental agreement you promise to return the above rented equipment on the return date, clean and in good condition
1.2. You understand that you are responsible for all items and agree that you are liable for any charges necessary to replace equipment rented to you that becomes damaged or lost. The price for replacement is set by Pure Diving Aruba.
1.3. Pure Diving Aruba only rents equipment for the use of certified divers. Dive certification may be asked for upon renting. Whether the divers that will be using the gear are present at the time of rental gear delivery or pick up or not, the dive center or dive leader signing the rental agreement is held responsible.
1.4. The diver signing the rental agreement is responsible for the equipment.
1.5. By signing the rental agreement, you assume all and full responsibility for the use of the above equipment and waive all liability on the part of Pure Diving Aruba. You further waive all liability on the part of any employee of associate of Pure Diving Aruba for any injuries and/or accidents incurred while using said equipment.
1.6. You are responsible for inspecting the operation of the rented equipment and by signing the rental agreement, find it to be in proper working order.
1.7. Pure Diving Aruba will always assist in case the wrong size gear was accidentally rented, but assumes no obligation to do so in case unavailable, or outside of reasonable opening hours.
1.8. Back-up/spare equipment may be rented, but is not included in rental price.
1.9. A deposit may be required when renting equipment. This is at the discretion of Pure Diving Aruba or its employees.
1.10. In case of renting specialty diving equipment, such as fluorescent night diving equipment, Pure Diving Aruba may demand the hiring of one of its instructors or dive leaders. This is always the case with first time renters.
- Course Bookings
2.1. If the weather or any other circumstances beyond the control of Pure Diving Aruba cause the course to be delayed, changed or cancelled, no refund, no liability can be accepted by the aforesaid parties for consequential loss, damage or any expense incurred.
2.2. Candidates using Pure Diving Aruba or its partners’ equipment for any course are responsible for that equipment and will be charged for any loss or damage howsoever caused.
2.3. Candidates may not participate in diving activities without a satisfactorily completed medical statement, statement of understanding and assumption of risk. Any delays caused to the course by failure to complete these administrative and medical requirements will be chargeable at the current missed session rate.
2.4. Any non-attendance of scheduled sessions will be charged at the current missed session rate.
2.5. If Customers fail to meet the performance requirements on any dive or knowledge development session, at the sole discretion of the instructor, Pure Diving Aruba reserves the right to charge for repeating that dive or session, the rate for this will be based on the current missed session rate at that time and depend on the nature of the dive or session missed.
2.6. Neither Pure Diving Aruba, its partners, employees or contractors can be held responsible for damage to or loss of any personal equipment caused prior to, during or after any diving activities.
2.7. Course payments are non-refundable, but can be converted into a deposit to be used within a year.
2.8. Any charges incurred during the course will result in suspension of training and the withholding of certification until paid in full. Pure Diving Aruba reserves the right to charge outstanding fees to the customer’s credit/debit card.
2.9. Pure Diving Aruba reserves the right to charge an administration fee for any amendments to scheduled sessions on a booked course that are requested by the customer. This fee may be charged in addition to a missed session fee at the discretion of Pure Diving Aruba.
2.10. At the start of the course an induction will be given to the specific course and the requirements of that course.
2.11. All courses must be commenced within 6 months of the booking unless by prior agreement of Pure Diving Aruba, courses not commenced within 6 months of booking will lose any fees paid.
2.12. Candidates and clients agree to abide by the rules and decisions of Pure Diving Aruba, its partners, staff and subcontractors in all diver-training matters.
2.13. Course deposits are non-refundable. If a course is cancelled by purchaser 14 days or more prior to the agreed start date, then the deposit can be transferred to another available course.
2.14. Cancellations made by purchaser within 7 days before the course will be liable for the costs of materials purchased by Pure Diving Aruba for the student(s).
2.15. Cancellations made by purchaser 3 days before the course start will be liable for the 50% charge, deposit and balance of the course booked.
2.16. Cancellations made by purchaser 24 hours or less before the course will be liable for 100% charge, deposit and balance of the course booked.
2.17. No refunds after the course has started.
2.18. A Pure Diving Aruba employee or associate can never be held liable or responsible for damage, injury or loss of life to/of another dive operator or client, or their property.
2.19 A deposit may be charged (or a filled-out credit card authorization form requested) at the time of the booking to confirm the booking.
- Dive Trips Bookings
3.1. All divers listed on a boat or shore dive booking will be included in the booking, and the charges will be applied to all spaces booked.
3.2. The Dive Centre reserves the right to change sites or vessels without notice, due to weather, safety, suitability, diver experience or any other reason.
3.3. If a dive is cancelled for any reason the deposit will be used towards another dive in the same year.
3.4. Once the vessel has left dock the dive will be considered to be taking place.
3.5. Deposits may be moved to subsequent years at the discretion of the Dive Centre.
3.6. A deposit may be charged (or a filled-out credit card authorization form requested) at the time of the booking to confirm the booking.
3.7. Cancellations made 14 days or more prior to the dive date, any deposit may be moved to another dive in the same year at the discretion of Pure Diving Aruba.
3.8 Cancellations made within 3 days before the booking will be liable for 50% of the charge, deposit and balance of all dives booked.
3.9. Cancellations made within 24 hours before the booking will be liable for the full charge, deposit and balance of all dives booked.
3.10. Pure Diving Aruba reserves the right to refuse divers to dive if in the opinion of Pure Diving Aruba the diver is not suitable for the chosen dive for any reason. In this case the diver will be liable for the full charge of the dive.
3.11. In all matters relating to boat or shore bookings the Pure Diving Aruba decision is final.
3.12. All Divers agree to abide by the Pure Diving Aruba Diving & Boating Practices at all times, a copy of which is available on request, the Pure Diving Aruba decision on any diving or boating matters is final.
3.13. Please Note: Pure Diving Aruba reserves the right to cancel a boat dive if only 2 or less payable divers booked a boat dive. Minimum number of divers on the boat is 3. In that case Dive Centre can offer Shore Dive instead Boat dive or reschedule Boat Dive to another day.
3.14. No minimum number of divers for shore dive.
- Gift cards
4.1. Gift cards are available upon request and not valid until signed by Pure Diving Aruba representative.
4.2. Gift cards expire one year after date of issue, unless written extension of validity is given by Pure Diving Aruba.
